It is Ordered that the motion and cross motion are consolidated for disposition. It is further Ordered that plaintiff-respondent's motion to dismiss the appeal is granted, unless defendants-appellants perfect their appeals by no later than the March 2013 term - the filing deadline is January 9, 2013. In the event of defendant-appellant's failure to comply with the foregoing condition, plaintiff-respondent may move, on five days' notice, for an order dismissing the appeals.
