Appellants having moved to consolidate and extend the time to perfect the appeals taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Erie on February 24, 2012 (appeal No.1), March 5, 2012 (appeal No. 2), and April 20, 2012 (appeal Nos. 3, 4 and 5),
Now, upon reading and filing the affidavit of Katherine E. Wild, Esq., sworn to November 20, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to consolidate the appeals is granted and the appeals from the orders entered February 24, 2012, March 5, 2012, and April 20, 2012, are hereby consolidated for the purposes of perfecting and arguing the appeals, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the appeals from the orders entered February 24, 2012, and March 5, 2012, is granted, and appellant shall perfect the appeals from the orders entered February 24, 2012, and March 5, 2012, on or before December 31, 2012, and, in the event of failure to so perfect, the appeals from the orders entered February 24, 2012, and March 5, 2012, are hereby dismissed without further order, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect the appeals from the orders entered April 20, 2012 is dismissed as premature (see 22 NYCRR 1000.13 [f]).
