Motion by tenant Hardas Kripalani for an extension of time to file a notice of appeal from a final judgment of the Civil Court of the City of New York, Queens County, entered May 11, 2012. Cross motion by respondent to dismiss the appeal from the final judgment entered May 11, 2012.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is
ORDERED that the motion by tenant Hardas Kripalani for an extension of time to file a notice of appeal is denied (see CPLR 5513 [a]; 5514 [c]); and it is further,
ORDERED that respondent's cross motion is denied as academic.
