DECISION & ORDER ON MOTION
| Mid Island, L.P. etc., Respondent, v Hardas Kripalani, Appellant, and Naina Kripalani, Tenant. |
Motion by appellant on appeals from a judgment of the Civil Court of the City of New York, Queens County, entered July 31, 2012, and an order of the same court entered August 28, 2012, to stay enforcement of the judgment pending the determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted on condition that the appeal be perfected by February 1, 2013 and on the further condition that appellant deposit the sum of $3,900 within 10 days of the date of this decision and order; and it is further,
ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
