DECISION AND ORDER ON MOTION |
Motion for extension of time to perfect appeals and to unseal certain records.
Cross motion for preference, to
unseal certain records conditionally and for further relief.
Upon the papers filed in support of the motion and the cross motion and the
papers filed in opposition thereto, it is
ORDERED that the cross motion for a preference is granted, without costs, to the extent that the
appeals are set down for the March 2013 term of this Court. Appellant shall file and serve a record on appeal and brief on or before January 3,
2013. The responding brief or briefs shall be filed and served on or before February 4, 2013. The reply brief, if any, shall be filed and served on
or before February 14, 2013, and it is further
ORDERED that the motion for an extension of time to perfect the appeals is granted,
without costs, and the time to perfect the appeals is extended to January 3, 2013, and it is further
ORDERED that the motion to unseal
certain records is denied, without costs, and it is further
ORDERED that the cross motion to unseal certain records conditionally and for
further relief is denied, without costs, and respondents shall file, in camera, with this Court on or before January 3, 2013 only those sealed
records that were before Supreme Court that pertain to the instant appeals.
