| DECISION & ORDER ON MOTION |
Motion by the respondent on an appeal from an order of the Supreme Court, Westchester County, entered July 20, 2012, to vacate a stay of enforcement contained in a decision and order on motion of this Court dated October 1, 2012, which, inter alia, stayed enforcement of the order entered July 20, 2012, on condition that the appeal was perfected by October 31, 2012, and to dismiss the appeal for failure to perfect in accordance with the decision and order on motion of this court dated October 1, 2012.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to vacate the stay is granted; and it is further,
ORDERED that the motion is otherwise denied.
