Plaintiff having moved for an extension of time to file and serve a brief on the appeals of Hollands International Field Airport and Al Hollands taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Erie on January 5, 2012, and March 20, 2012, having moved for this Court to accept plaintiff's brief returned by this Court insofar as it relates to the other defendants' appeals and plaintiff's cross appeal from the orders entered January 5, 2012, and March 20, 2012, and having moved for other relief,

Now, upon reading and filing the affirmation of Paul Becker, Esq., dated November 13, 2012, the notice of motion with proof of service thereof, and the affirmation of R. William Stephens, Esq., dated November 19, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve plaintiff's respondent's brief on the appeals of Hollands International Field Airport, Al Hollands, and Daystar Trading & Ventures, LLC, is granted on the condition that the brief is filed

and served on or before December 27, 2012, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that reply briefs in response to plaintiff's respondent's briefs and any briefs in response to plaintiff's cross appeal shall be filed and served on or before January 11, 2012, and the Clerk is directed to accept the briefs for filing, and

It is further ORDERED that the motion insofar as it seeks to vacate dismissal of plaintiff's cross appeal from the order entered January 5, 2012, is granted on the condition that the cross appeal is perfect on or before December 27, 2012, and

It is further ORDERED that the motion insofar as it seeks an extension of time to perfect plaintiff's cross appeal from the order entered March 20, 2012, is granted on the condition that the cross appeal is perfected on or before December 27, 2012.
