Motion by appellant for leave to reargue her prior motion to vacate an order of this court dated April 30, 2012, which dismissed an appeal from an order of the Civil Court of the City of New York, Kings County, entered October 29, 2009, which prior motion was denied by decision and order of this court dated July 27, 2012, or, in the alternative, for leave to appeal to the Appellate Division from the order of this court dated April 30, 2012 and the decision and order of this court dated July 27, 2012, and for related relief. Cross motion by respondent to dismiss the appeal.
Upon the papers filed in support of the motion and cross motion, and the papers filed in opposition thereto, it is
ORDERED that appellant's motion is denied; and it is further,
ORDERED that respondent's motion is denied as academic.
