Motion by the respondent on an appeal from an order of the Supreme Court, Orange County, dated November 21, 2011, to enlarge the record to include an order of the same court dated August 1, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted to the extent that the Court shall take judicial notice of the order dated August 1, 2012, and the motion is otherwise denied; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until January 16, 2013, and the respondent's brief must be served and filed on or before that date.
