DECISION & ORDER ON MOTION

Motion by appellant on an appeal from a judgment of conviction of the Village Court of Spring Valley, Rockland County, rendered March 11, 2011, in effect, for an enlargement of time to perfect the appeal. Appellant also seeks to have the court "waive the complete record and have the appeal heard on the transcript submitted with the filed brief."
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the appellant's brief shall be served and filed on or before January 3, 2013, and it is further
ORDERED that the branch of the motion seeking to "waive the complete record" is denied as moot, in as much as the record, including the transcripts, has been filed with the court
