DECISION & ORDER ON APPLICATION

Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) on an appeal from a judgment of the County Court, Orange County, rendered February 3, 2011, inter alia, to enlarge the time to serve and file a brief in accordance with a decision and order of this Court dated May 8, 2012.

Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application is granted the appellant's time to serve and file a brief is enlarged, and the appellant's brief submitted to the Clerk of this Court is accepted for filing and deemed timely served.
