| DECISION & ORDER ON MOTION |
Motion by the appellant, inter alia, to vacate a decision and order on motion of this Court dated August 21, 2012, which, inter alia, granted the respondent's cross motion to dismiss an appeal from an order of the Supreme Court, Kings County, dated May 18, 2011, and reinstate the appeal. Cross motion by the respondent to impose a sanction upon the appellant.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion and the cross motion are denied; and it is further,
ORDERED that on the Court's own motion, the appellant is precluded from making any further motions in the above-entitled appeal without prior leave of this Court.
