It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that tenant-appellant's motion to amend is considered a motion to consolidate the appeals and is granted. Tenant-appellant's motion for an enlargement of time to perfect is granted on condition that he perfect his appeal by no later than the April 2013 term - the filing deadline is February 5, 2013. Landlord-respondent's cross-motion to dismiss is denied. In the event of tenant-appellant's failure to comply with the foregoing condition, landlord-respondent may move, on five days' notice, for an order dismissing the appeal.
