DECISION & ORDER ON MOTION

Motion by appellant on an appeal from an order of the City Court of White Plains, Westchester County, entered September 28, 2011, for an enlargement of time to comply with the terms of a decision and order of this court dated November 15, 2012, and to continue a stay granted by decision and order of this court dated November 28, 2011 and extended by decision and order dated February 28, 2012.
Upon the papers filed in support of the motions and no papers filed in opposition thereto, it is
ORDERED that the branch of the motion seeking an enlargement of time to comply with the terms of the decision and order of this court dated November 15, 2012 is granted and appellant's deposit made pursuant to that decision and order is deemed to have been timely made; and it is further,
ORDERED that the branch of the motion seeking to continue the stay is granted on condition that appellant continue to comply with the terms of the decision and order of this court dated November 15, 2012; and it is further,
ORDERED that in the event that the remaining conditions contained in the decision and order of this court dated November 15, 2012 are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
