DECISION & ORDER ON MOTION

Appeal by Jillian Deerkoski from an order of the Family Court, Suffolk County, dated April 9, 2012. By scheduling order dated May 17, 2012, the appellant was directed to perfect the appeal within 60 days after the transcript was received. Subsequently, the appellant notified the Court that the transcript was received and was advised to perfect the appeal on or before December 7, 2012. The appellant has not yet perfected the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed for failure to comply with the scheduling order dated May 17, 2012 (see 22 NYCRR 670.4[a][2]).
