Respondent Annie Pearl Pugh having moved for permission to proceed as a poor person, for assignment of counsel and for the stay to be lifted on this CPLR article 78 proceeding,
Now, upon reading and filing the affidavit of James Eckert, Esq., sworn to November 8, 2012, the affidavit of Annie Pugh sworn to November 26, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks permission to proceed as a poor person is granted, and
It is further ORDERED that the motion insofar as it seeks assignment of counsel is dismissed on the ground that the Monroe County Public Defender has already appeared in this proceeding on behalf of Annie Pearl Pugh, and
It is further ORDERED that the motion insofar as it seeks to lift the stay is denied.
