| DECISION & ORDER ON MOTION |
Appeals by Hersh Pasternak and Frederick Bevelaqua from two orders of the Supreme Court, Queens County, entered June 27, 2012, and October 23, 2012, respectively. By decision and order on motion of this Court dated November 20, 2012, the inquest on the issue of damages in the above-entitled action was stayed pending hearing and determination of the appeals on condition that the appeals were perfected on or before December 19, 2012. The appellants have not perfected the appeals.
Now, on the Court's own motion, it is
ORDERED that the stay of the inquest on the issue of damages granted by the decision and order on motion of this Court dated November 20, 2012, is vacated.
