DECISION & ORDER ON MOTION

Motion by the appellants to enjoin the respondent Vassar College and its agents from implementing the program authorized by the permit issued by the respondent New York State Department of Environmental Conservation on December 14, 2012, pending hearing and determination of an appeal from an order of the Supreme Court, Dutchess County, dated December 21, 2012.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
