DECISION & ORDER ON MOTION

Motion by Mark Gordon and Audrey Pierot for leave to appeal to this Court from an order of the Supreme Court, Westchester County, entered October 2, 2012. Separate motion by Mark Gordon and Audrey Pierot, inter alia, to stay certain proceedings before the Town of Greenburgh Zoning Board of Appeals, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion for leave to appeal and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion, inter alia, to stay certain proceedings before the Town of Greenburgh Zoning Board of Appeals and the papers filed in opposition thereto, it is

ORDERED that the motion for leave to appeal is denied; and it is further,

ORDERED that the motion, inter alia, to stay certain proceedings before the Town of Greenburgh Zoning Board of Appeals is denied as academic.
