DECISION & ORDER ON MOTION
| St. Catherine of Sienna Roman Catholic Church at St. Albans Queens County, Respondent, v 118 Convent Associates, LLC and Quick Start Day Care Center, Inc., Appellants. |
Motion by appellants for an enlargement of time to perfect an appeal from an order of the Civil Court of the City of New York, Queens County, entered June 29, 2012, and to continue a stay granted by decision and order of this court dated September 24, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by February 3, 2013; and it is further,
ORDERED that the branch of the motion seeking to continue the stay granted by decision and order of this court dated September 24, 2012 is granted on condition that appellants perfect the appeal by February 3, 2013 and continue to comply with the other conditions contained in the decision and order of this court dated September 24, 2012; and it is further,
ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
