DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue his prior motion, inter alia, to reinstate an appeal from a decision of the Supreme Court, Queens County, dated December 7, 2011, which was dismissed by decision and order on motion of this Court dated April 17, 2012, and to consolidate that appeal with an appeal from an order of the same court entered June 6, 2012, which was determined by decision and order on motion of this Court dated April 17, 2012, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order on motion of this Court dated April 17, 2012, and to enlarge the time to perfect the appeal from the order entered June 6, 2012.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal from the order is granted, the appellant's time to perfect the appeal is enlarged until March 12, 2013, and the record or appendix on that appeal and the appellant's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
