(Index No. 202269/00)

DECISION & ORDER ON MOTION

Motion by the respondent on appeals from two orders of the Supreme Court, Nassau County, dated August 22, 2011 and June 15, 2012, to dismiss the appeal from the order, dated June 15, 2012, on the ground that no appeal lies from an order denying reargument.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted to the extent that the appeal from so much of the order dated June 15, 2012, as denied reargument is dismissed, without costs or disbursements, and the motion is otherwise denied.

ANGIOLILLO, J.P., LEVENTHAL, LOTT and AUSTIN, JJ., concur.
