DECISION & ORDER ON MOTION

Motion by IG Second Generation Partners, L.P., and I Bldg. Co., Inc., to supplement the record on an appeal from an order of the Supreme Court, Queens County, dated January 17, 2012, and an appeal and cross appeal from an order of the same court dated March 9, 2012, to include certain documents and to enlarge their time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted and on or before January 29, 2013, IG Second Generation Partners, L.P., and I Bldg. Co., Inc., shall serve and file (1) a supplemental record containing their verified answer with counterclaim under Index No. 3992/07, verified answer with counterclaim under Index No. 10073/08, notice of petition in Civil Court of the City of New York, Queen County, Index No. L & T 62552, and notice of settlement dated February 4, 2012, with proposed judgment, and (2) their brief, containing their points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]).
