Motion by appellant on appeals from a judgment of the Civil Court of the City of New York, Queens County, entered July 31, 2012, and an order of the same court entered August 28, 2012, to modify a stay granted by decision and order of this court dated December 4, 2012. Cross motion by respondent to vacate the stay.
Upon the papers filed in support of the motion and cross motion and the papers filed in opposition to the motion, it is
ORDERED that appellant's motion is denied; and it is further,
ORDERED that respondent's cross motion is granted and the stay is vacated.
