| DECISION & ORDER ON MOTION |
Appeal by Janet L. Garaguso from an order of the Family Court, Orange County, dated May 1, 2012. By decision and order on motion of this Court dated November 21, 2012, the appellant was directed to comply, on or before December 21, 2012, with a scheduling order contained in the decision and order on motion dated November 21, 2012, and was advised that failure to comply would result in the dismissal of the appeal without further notice. The appellant has not complied with the scheduling order.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the scheduling order contained in the decision and order on motion of this Court dated November 21, 2012 (see 22 NYCRR 670.4[a][2], 670.8[e]).
