Defendant having moved to vacate the dismissal of the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on December 30, 2011, and having moved to consolidate the appeals taken herein from orders entered in the Office of the Clerk of the County of Monroe on December 30, 2011 (appeal No. 1), April 26, 2012 (appeal No. 2), and November 20, 2012 (appeal No. 3),

Now, upon reading and filing the affirmation of Donald A. White, Esq., dated December 13, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to vacate dismissal of the appeal from the order entered December 30, 2011, is granted, on the condition that defendant perfects the appeal on or before February 19, 2013, and

It is further ORDERED that the motion insofar as it seeks to consolidate the appeals is granted and the appeals from the orders entered December 30, 2011, April 26, 2012, and November 20, 2012, are hereby consolidated for the purposes of perfecting and arguing the appeals.
