Appellants having moved to withdraw without prejudice the appeal taken herein from an order of Supreme Court entered in the Office of the Clerk of the County of Oneida on December 30, 2011, or, in the alternative, to extend their time to perfect the appeal,
Now, upon reading and filing the affirmation of Susan H. Odessky, Esq., dated December 13, 2012, the notice of motion with proof of service thereof, and the affirmation of Norman P. Deep, Esq., dated December 19, 2012, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is denied insofar as it seeks to withdraw the appeal without prejudice, and
It is further ORDERED that the motion is granted insofar as it seeks an extension of time to perfect the appeal, and appellants shall perfect the appeal on or before February 22, 2013, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
