The People of the State of New York, Respondent, v Robert Turner, Appellant.

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered September 25, 2012, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in response thereto, it is

ORDERED that the motion is denied as moot since the relief requested was granted to appellant by decision and order of this court dated December 13, 2012.
