| DECISION & ORDER ON MOTION |
Motion by the appellant pro se, inter alia, to reinstate an appeal from an order of the Supreme Court, Kings County, dated January 19, 2011, which was dismissed by a decision and order on motion of this Court dated August 8, 2012, for poor person relief, and, in effect, to waive the motion filing fee. Cross motion by the respondents to impose a sanction upon the appellant.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is it is
ORDERED that the branch of the motion which is to waive the motion filing fee is denied as unnecessary (see 22 NYCRR 670.22[a][2]); and it is further,
ORDERED that the motion and the cross motion are denied.
