ORDERED that the order on application of this Court dated January 9, 2013, in the above-entitled appeal from a judgment of the County Court, Orange County, rendered February 23, 2012, is amended by deleting from the caption thereof the name "William McMillan," and substituting therefor the name "Michael McMillan".
