On the Court's own motion, it is
ORDERED that the order on application of this Court dated January 24, 2013, in the above-entitled case is recalled and vacated, and the following order on application is substituted therefor:
Application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Kings County, dated September 6, 2012.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application is granted and the respondent's time to serve and file a brief is enlarged until February 28, 2013, and the respondent's brief must be served and filed on or before that date.
