On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated January 29, 2013, in the above-entitled matter, on an appeal from an order of the Supreme Court, Kings County, dated February 1, 2012, is amended by deleting from the first paragraph thereof the words "Cross motion by the appellant" and substituting therefor the words "Cross motion by the respondent."
