On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated January 22, 2013, in the above-entitled matter, on an appeal from an order of the Supreme Court, Suffolk County, entered November 19, 2012, is amended by deleting the first decretal paragraph thereof and substituting therefor the following paragraph:
ORDERED that the motion is granted to the extent that the trial in the above-entitled action and all proceedings in a matter entitled Buttafuoco & Associates, PLLC v Urias, pending in the Supreme Court, Nassau County, under Index No. 15468/12, are stayed pending hearing and determination of the appeal on condition that the appeal is perfected on or before March 8, 2013, and the motion is otherwise denied; and it is further,
