| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Kings County, dated February 13, 2011, in effect, to amend the second decretal paragraph of a decision and order on motion of this Court dated July 24, 2012, which directed him to serve and file a supplemental record containing certain documents. Application by the respondents pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief. Separate application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a reply brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, upon the papers filed in support of the respondents' application and the papers filed in opposition thereto, and upon the papers filed in support of the appellant's application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the decision and order on motion of this Court dated July 24, 2012, is amended by deleting the second decretal paragraph thereof and substituting the following paragraph:
"ORDERED that the branch of the motion which is to direct the appellant to serve and file a supplemental record is granted, and on or before September 10, 2012, the appellant shall serve and file a second supplemental record containing (1) Exhibits A, B, and C to letter from the appellant to Hon. Yvonne Lewis dated August 10, 2012, and (2) affirmation of Dr. Ranga C. Krishna regarding an examination conducted on August 6, 2007; and it is further,"
; and it is further,
ORDERED that the respondents' application is granted, and the respondents' brief submitted to the Clerk of the Court is accepted for filing and deemed timely served; and it is further,
ORDERED that the appellant's application is granted, the appellant's time to serve and file a reply brief is enlarged until February 20, 2013, and the reply brief shall be served and filed on or before that date.
