Motion by respondent on an appeal from a final judgment of the City Court of the City of Glen Cove, Nassau County, entered September 10, 2012, to vacate a stay granted by decision and order of this court dated November 23, 2012, and for the release of funds on deposit.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion seeking to vacate the stay contained in the decision and order of this court dated November 23, 2012 is granted; and it is further,
ORDERED that the branch of the motion seeking the release of funds on deposit is granted and the funds on deposit are directed to be released to respondent Glen Arms Group, LLC, less any lawful fees.
