| DECISION & ORDER ON MOTION |
Motion by the appellant to stay the retrial on the issue of damages, pending hearing and determination of appeals from two orders of the Supreme Court, Kings County, dated February 24, 2012, and November 28, 2012, respectively, and to consolidate the appeals.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the branch of the motion which is to stay the retrial on the issue of damages is granted and the retrial on the issue of damages is stayed pending hearing and determination of the appeals; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied; and it is further,
ORDERED that on the Court's own motion, the appeals will be calendared together and will be argued or submitted on the same day.
