| DECISION & ORDER ON MOTION |
Motion by the respondent to be provided with the transcript of the grand jury minutes on an appeal from an order of the Supreme Court, Nassau County, entered May 4, 2010, and to enlarge the time to serve and file a respondent's brief.
Upon the papers filed in support of the motion and the papers filed in opposition or in relation thereto, it is
ORDERED that the motion is granted an on or before February 27, 2013, the appellant shall serve the respondent with a copy of the transcript of the grand jury minutes; and it is further,
ORDERED that the respondent's time to serve and file a brief on the appeal is enlarged until April 29, 2013, and the respondent's brief shall be served and filed on or before that date.
