| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Kings County, dated May 3, 2012, on the ground that the record on appeal is inadequate or, in the alternative, for leave to file a supplemental record on appeal and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is denied; and it is further,
ORDERED that the branch of the motion which is for leave to file a supplemental record on appeal and to enlarge the time to serve and file a brief is granted, and on or before March 12, 2013, the respondent shall serve and file the respondent's brief as well as a supplemental record on appeal containing duplicate color photographs of the five photographs that were marked as exhibits at the respondent's deposition and annexed to the respondent's motion papers as Exhibit A.
