DECISION & ORDER ON MOTION
| Mautner-Glick Corporation and Gerald P. Halpern as Executor of the Estate of Fred Zeiss, Respondents, v Mark Tunne, Appellant. |
Motion by appellant for leave to reargue appeals from two orders of the Civil Court of the City of New York, New York County, dated, respectively, December 4, 2006 and October 26, 2009, and a final judgment of the same court entered October 19, 2009, which were determined by decision and order of this court dated December 18, 2012, or, in the alternative, for leave to appeal to the Appellate Division from the decision and order of this court. Separate motion by appellant for a stay of the execution of the warrant of eviction, "restoration to possession pending all exhausted appeals before the court," and for a stay of reletting. The appeals were transferred to this court by a decision and order of the Appellate Division, Second Department, dated May 17, 2011.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that appellant's motions are consolidated for disposition; and it is further,
ORDERED that appellant's motions are denied.
