Application by the defendant-respondent-appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal and cross appeals from an order of the Supreme Court, Richmond County, dated June 12, 2012.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted and the defendant-respondent-appellant's time to serve and file an answering brief, including its points of argument on the cross appeal (see 22 NYCRR 670.8[c][3]), is enlarged until March 21, 2013, and the defendant-respondent-appellant's brief shall be served and filed on or before that date; and it is further,
ORDERED that the plaintiff-respondent-appellant shall serve and file his answering brief, including his points of argument on his cross appeal (see 22 NYCRR 670.8[c][3]), on or before April 22, 2013; and it is further,
ORDERED that the defendant-respondent shall serve and file its brief on or before May 22, 2013; the plaintiff-respondent-appellant and the appellant-respondent shall serve and file their reply briefs on or before June 3, 2013; and the defendant-respondent-appellant shall serve and file its reply brief on or before June 13, 2013.
