DECISION & ORDER ON MOTION

Renewed motion by the respondent to dismiss an appeal from a judgment of the Supreme Court, Westchester County, rendered September 24, 2012, on the ground that the appellant has absconded and is no longer available to comply with the mandate of the Court.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the appeal is dismissed, on the ground that the appellant has absconded and is no longer available to comply with the mandate of the Court (see People v Taveras, 10 NY3d 227).
