Now, upon reading and filing the affirmation of Marcus J. Mastracco, Esq., dated January 7, 2013, the notice of motion with proof of service thereof, and the statement of Joshua Liner dated January 16, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that the supplemental return and brief are filed and served in accordance with this Court's rules on or before March 8, 2013, and the Clerk is directed to accept the brief and supplemental return for filing, and

It is further ORDERED that the proceeding is removed from this Court's day calendar for February 19, 2013, and added to the Court's calendar for the term commencing April 1, 2013.
