It is Ordered that the motion and cross motion are consolidated for disposition.
It is further Ordered that tenant-respondent's cross-motion to dismiss is granted, unless landlord-appellant perfects its appeal by no later then the May 2013 term - the filing deadline is March 13, 2013. In the event of landlord-appellant's failure to comply with the foregoing condition, tenant-respondent may move, on five days notice, for an order dismissing the appeal.
