Motion by appellant to vacate an order of this court dated November 13, 2012, which dismissed an appeal from a judgment of the District Court of Nassau County, Second District, entered May 14, 2012.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the court's order dismissing the appeal is vacated; and it is further,
ORDERED on th court's own motion that the time to file appellant's brief is hereby enlarged and appellant's brief shall be served and filed on or before March 1, 2013.
