Motion by appellant for leave to reargue a prior motion by respondent to dismiss, as untimely, an appeal from an oral order of the Justice Court of the Town of Southampton, Suffolk County, made November 15, 2011, which prior motion was determined by decision and order on motion of this court dated January 4, 2013.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
