The People of the State of New York, Appellant, v Veronica Telemaque, Respondent.

Motion by appellant for leave to consolidate an appeal from an order of the Criminal Court

of the City of New York, Kings County, dated April 13, 2012 (Appeal No. 2012-1783 K CR), with an appeal from an order of the same court dated September 10, 2012 (Appeal No. 2012-2259 K CR).

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED, on the court's own motion, that the appeals are consolidated for the purpose of disposition of appellant's motion; and it is further,

ORDERED, on the court's own motion, that the appeal from the order dated April 13, 2012 (Appeal No. 2012-1783 K CR) is dismissed, as this order was superseded by the order dated September 10, 2012, made upon reargument; and it is further,

ORDERED that appellant's motion is denied as academic.
