Motion by appellant on an appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered July 26, 2012, to modify the terms of a stay granted by decision and order of this court dated January 16, 2013.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted and the decision and order of this court dated January 16, 2013 is modified by deleting from the first decretal paragraph the words "deposit with the court below" and substituting therefor "pay to respondent," and by deleting the second sentence of that decretal paragraph.
