DECISION & ORDER ON MOTION

Motion by the appellant pro se to enlarge the time to perfect an appeal from a judgment of the Supreme Court, Kings County, rendered December 8, 2010, for leave to prosecute the appeal as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the Court's own motion, on or before May 6, 2013, the appellant's retained counsel, Amelio P. Marino, Esq., is directed to either perfect the appeal or move for leave to withdraw as counsel if the appellant is not willing to consent to the filing of the brief prepared by retained counsel.
