Appellant having moved for an extension of time to perfect the appeal taken from an order of Erie County Court, dated July 13, 2012, and for other relief,

Now, upon reading and filing the affirmation of Michael J. Dowd, Esq. dated February 5, 2013, the notice of motion with proof of service thereof, the affidavit of Nicholas T. Texido, Esq. sworn to February 20, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the ordering paragraph of the order of this Court entered January 7, 2013 is hereby amended by striking therefrom the date February 6, 2013 and inserting in place thereof the date May 29, 2013, and

It is further ORDERED that the motion insofar as it seeks poor person relief and assignment of counsel is denied with leave to renew upon the filing and serving of an application seeking leave to appeal as a poor person and assignment of counsel pursuant to 22 NYCRR 1000.14, and

It is further ORDERED that the motion is otherwise denied.
