DECISION & ORDER ON MOTION

Motion by Mark Tunne, inter alia, for leave to appeal to this Court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated December 18, 2012, which, inter alia, affirmed a judgment of the Civil Court of the City of New York, New York County, entered October 19, 2009, and to stay the petitioner from reletting the subject apartment, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
